1. Acceptance of Terms
By accessing or using the labsyMedicare platform (the "Platform"), including our website and mobile application, you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
These Terms apply to all users, including customers, registered agents, and visitors.
2. Description of Services
labsyMedicare provides a technology platform that connects customers with certified diagnostic agents for home-based medical sample collection and laboratory testing services in West Bengal, India. Our services include:
- Home sample collection by certified agents
- Coordination with accredited partner laboratories
- Digital delivery of lab reports
- Appointment booking and management
We are a service intermediary. We do not directly provide medical diagnosis or treatment advice.
3. User Accounts & Registration
- You must be at least 18 years old to create an account (or have parental consent if 13–17)
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
- We reserve the right to suspend or terminate accounts that violate these Terms
- One person may not maintain multiple accounts
4. Booking, Payment & Cancellation
- All bookings must be made through the official labsyMedicare platform
- Payment is due at the time of booking unless otherwise specified
- Prices displayed are inclusive of all applicable taxes unless stated otherwise
- Cancellations and refunds are governed by our Refund Policy
- We reserve the right to modify pricing with 7 days' advance notice
- Fraudulent payments or chargebacks will result in account suspension and legal action
5. User Obligations
As a user of our platform, you agree to:
- Provide a safe and accessible environment for the agent during sample collection
- Ensure a responsible adult (18+) is present at the time of the appointment
- Provide accurate address, contact information, and medical instructions
- Not misuse, abuse, or harass any agent or labsyMedicare staff
- Not use the platform for any unlawful purpose
- Not attempt to reverse-engineer, hack, or compromise platform security
- Not book services on behalf of others without their knowledge and consent
6. Medical Disclaimer
Important: labsyMedicare is a diagnostic facilitation service and does NOT provide medical advice, diagnosis, or treatment.
- Lab results should be interpreted by a qualified medical professional
- Do not make healthcare decisions based solely on platform communications
- In a medical emergency, contact emergency services (112) immediately
- The accuracy of test results depends on the accredited laboratory; we are not liable for laboratory errors
7. Agent Standards & Conduct
All labsyMedicare agents must:
- Be certified and trained in sample collection procedures
- Carry valid ID and labsyMedicare credentials at all times
- Follow all medical safety and hygiene protocols
- Treat customers with respect and professionalism

8. Intellectual Property
All content on the labsyMedicare platform — including logos, text, graphics, software, and design — is the exclusive property of labsyMedicare and is protected under applicable intellectual property laws.
- You may not copy, reproduce, or distribute our content without written permission
- Unauthorized use of our trademarks is strictly prohibited
- User-submitted content (such as reviews) grants us a non-exclusive license to display it on our platform
9. Limitation of Liability
To the maximum extent permitted by applicable law, labsyMedicare shall not be liable for:
- Any indirect, incidental, or consequential damages arising from use of our services
- Errors or delays by partner laboratories in processing or delivering results
- Decisions made based on lab results without professional medical consultation
- Service interruptions due to technical failures, natural disasters, or force majeure events
Our maximum liability to any customer for any claim shall not exceed the amount paid for the specific service in question.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
We encourage amicable resolution of disputes. Before pursuing legal action, please contact our support team at legal@labsymedicare.com.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or in-app notification.
